1. Agreement
These terms govern your use of the GXPOL website, client portal and API (together, the "Service"). By using the Service you agree to them. If you are accepting on behalf of an organisation, you confirm you are authorised to do so.
2. What the Service is — and is not
GXPOL provides quantitative market analysis. It is not investment advice, is not a personal recommendation, and does not take account of your objectives, circumstances or risk tolerance. Nothing in the Service is an offer or solicitation to buy or sell any instrument. You remain solely responsible for your investment decisions and should obtain independent advice where appropriate.
3. Access and keys
Access keys are issued to a named client and must not be shared, resold or published. You are responsible for keeping your key confidential and for all activity under it. Tell us immediately at security@gxpol.com if you believe a key has been exposed. We may suspend or revoke a key where it has been compromised, shared, or used in breach of these terms.
4. Acceptable use
You may not: redistribute, resell or sublicense GXPOL outputs without written agreement; attempt to reconstruct the underlying methodology by systematic extraction; exceed documented rate limits or circumvent access controls; or use the Service in breach of applicable law or sanctions.
Reasonable internal use — including within research notes and committee papers of your own organisation — is permitted and expected, with attribution.
5. Intellectual property
The Service, its models, and its outputs remain the intellectual property of GXPOL. Your subscription grants a non-exclusive, non-transferable licence to use the outputs for internal purposes for the term of the subscription.
6. Accuracy and availability
The Service depends on third-party data. We take reasonable care, disclose data-quality degradation where we detect it, and version our methodology — but we do not warrant that outputs are error-free, uninterrupted, or fit for any particular purpose. Model outputs are probabilistic; past regime behaviour does not guarantee future outcomes.
7. Liability
To the fullest extent permitted by law, GXPOL is not liable for investment losses, lost profits, or indirect or consequential loss arising from use of the Service. Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence. Subject to that, our aggregate liability is limited to the fees paid by you in the twelve months preceding the claim.
8. Termination
Either party may terminate a subscription in accordance with the subscription agreement. We may suspend access immediately for breach of these terms. On termination, your licence to use the outputs ends, save for material already embedded in your internal records.
9. Governing law
These terms are governed by the laws of Jersey, and the courts of Jersey have exclusive jurisdiction.
10. Changes
We may update these terms. Material changes will be notified to clients directly, and the date above will change.
